Acceptance & Eligibility
These Terms of Service (the "Terms") govern your use of the RealtrAI platform at realtrai.com and related services (the "Services"). RealtrAI is operated by Trunnion AI, a wholly-owned subsidiary of Viceroy NM, headquartered in Albuquerque, New Mexico ("RealtrAI," "we," "our").
By using the Services, you accept these Terms
If you create an account, click an "I agree" or similar acceptance, access the platform, or use any Service feature, you accept these Terms and the Privacy Policy. If you do not accept, do not use the Services.
Eligibility
You may use the Services only if you are at least 18 years old, are a real estate professional or are using the Services on behalf of one, can form a legally binding contract under applicable law, and are not prohibited from using the Services under any applicable law or sanctions regime.
Authority for Teams and Brokerages
If you accept these Terms on behalf of a team or brokerage, you represent that you have the authority to bind that organization to these Terms. References to "you" include both the individual and the organization where applicable.
Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at hello@realtrai.com if you suspect unauthorized access. We strongly recommend enabling multi-factor authentication.
The Services
RealtrAI provides a suite of AI-powered software tools for licensed real estate professionals. The current catalog includes seventeen tools spanning listings and marketing, investment analysis, client work, and compliance and audit functions. The full catalog is published at realtrai.com/tools.
Service Modifications
We may add, modify, replace, or discontinue tools, features, integrations, or capabilities at our discretion. For material changes (removing a tool entirely, materially limiting capability of an active feature), we provide reasonable advance notice via email and in-platform announcement, typically thirty (30) days.
Beta Features
From time to time, we may offer beta features marked "beta," "preview," "experimental," or similar. Beta features are provided as is, may change without notice, may be discontinued, and are not subject to the same uptime or support commitments as generally available features.
Service Availability
We aim for high availability but do not guarantee uninterrupted access. Routine maintenance windows are announced in advance when possible. Brokerage plans include negotiated uptime SLAs in their service agreements; non-Brokerage plans rely on our published service-status page and reasonable best efforts.
Subscriptions, Fees & Billing
Subscription Plans
Plans and prices are listed at realtrai.com/pricing. Current plans include Agent ($59/mo), Professional ($129/mo), Team ($299/mo for 5 seats, plus $45/mo per additional seat), and Brokerage (custom pricing). Plans paid annually receive a twenty (20) percent discount.
Free Trial
The seven-day free trial includes access to all seventeen tools and a generation cap of 50 documents during the trial window. No credit card is required to start a trial. At the end of the trial, you may subscribe or your account will roll into a free read-only mode (no new generation, but archive accessible) for up to thirty days.
Renewal and Auto-Pay
Subscriptions auto-renew at the end of each billing period (monthly or annually) at the then-current rate for your plan. You may cancel at any time from account settings; cancellation takes effect at the end of the current billing period.
Price Changes
We may change subscription prices. Price changes apply at the start of your next renewal period. We provide at least thirty (30) days' notice of any price increase via email to your account address. You may cancel before the increase takes effect to avoid the new rate.
Refunds
We do not pro-rate refunds for mid-cycle cancellations. Cancellation is effective at the end of the current billing period and you retain access through that period. Annual subscribers who cancel within fourteen (14) days of initial signup may request a full refund. If a defect or service failure prevents you from using the Services, contact hello@realtrai.com; we evaluate refund requests case-by-case in good faith.
Taxes
Subscription fees are exclusive of applicable sales, use, value-added, or similar taxes. Where we are required to collect such taxes, they are added to your invoice. You are responsible for any taxes that apply to your use of the Services in your jurisdiction.
Failed Payment
If a scheduled payment fails, we will retry the payment method per our payment processor's standard schedule and notify you. If payment cannot be collected within fourteen (14) days, we may suspend access until payment is current. Continued non-payment may result in account termination.
Acceptable Use
You agree not to use the Services in ways that violate law, infringe rights, or compromise the integrity of the platform. Specifically, you will not:
- Violate law: use the Services to violate any applicable law, regulation, or order, including real estate licensing laws, fair housing laws, anti-discrimination laws, securities laws, and consumer protection laws
- Misrepresent identity: impersonate another person, falsify your real estate license credentials, or hold yourself out as licensed in jurisdictions where you are not
- Infringe rights: upload, generate, or distribute content that infringes intellectual property, privacy, publicity, or other rights of third parties
- Distribute prohibited content: use the Services to create or distribute defamatory, harassing, deceptive, fraudulent, or unlawful content
- Bypass licensing: attempt to access MLS or other licensed data outside the scope of your verified license; share your account credentials with another person
- Reverse engineer: reverse engineer, decompile, or disassemble the Services, or attempt to extract source code or training data from the underlying models
- Abuse infrastructure: use automated systems to access the Services in ways that exceed normal usage; circumvent rate limits; or interfere with other accounts
- Resell or redistribute: resell, sublicense, or redistribute the Services to third parties as a standalone product (white-label use within your firm under a Brokerage plan is permitted)
- Generate prohibited material: use the Services to generate material that is threatening, harassing, sexually explicit, or harmful to minors
We reserve the right to investigate suspected violations, suspend access during investigation, and terminate accounts found to have violated these terms.
Reporting Abuse
If you become aware of a violation of these Acceptable Use terms, report it to hello@realtrai.com with subject "Abuse Report." We respond to all credible reports within five (5) business days.
Your Content & our IP.
Your Content
You retain all rights to the content you provide to the Services (property addresses, listing descriptions, attendee data, investor records, brand assets, photos, voice profiles, and similar) and to the documents, drafts, and outputs you generate using the Services ("Your Content").
You own Your Content. You may use it commercially, modify it, white-label it, distribute it, or delete it. We make no claim of ownership over Your Content. We do not use Your Content to train our underlying AI models. See the Privacy Policy for details on how Your Content is stored and protected.
License to Operate the Services
You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, transmit, display, and process Your Content solely as necessary to provide the Services to you (rendering it in the platform, generating outputs from it, delivering exports, syncing with integrations you authorize). This license terminates when you delete Your Content from the Services or when your account is terminated, subject to backup retention windows described in the Privacy Policy.
Your Responsibility for Your Content
You represent that you have the rights necessary to provide Your Content to the Services and to use any outputs you generate. You are responsible for ensuring that Your Content does not infringe third-party rights, violate law, or breach agreements with MLS providers, brokerages, or clients.
RealtrAI Intellectual Property
The Services, the underlying software, the Trunnion AI Declarative Agentic Framework, the user interface, the visual design, the brand assets (RealtrAI name and marks), and all related intellectual property are owned by Trunnion AI / Viceroy NM and are protected by copyright, trademark, trade secret, and other applicable laws. We grant you a limited, non-transferable, revocable license to use the Services for their intended purpose during the term of your subscription.
Feedback
If you provide feedback, suggestions, ideas, or proposals about the Services ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use the Feedback for any purpose without obligation to you. Feedback is voluntary; we do not require it.
Third-Party Services & Integrations
The Services connect to third-party services that you authorize, including MLS data providers, CRMs, website builders, payment processors, and identity providers. Your use of these third-party services is governed by their own terms and policies.
MLS Data
Access to MLS data is conditional on your active MLS license and on the MLS provider's licensing agreement with our data partners. We display data only within the scope of access your license entitles. If your license lapses, suspends, or terminates, MLS data access is correspondingly suspended.
Integrations You Authorize
When you connect an integration (Follow Up Boss, kvCORE, Sierra Interactive, BoomTown, Realvolve, Salesforce, Squarespace, WordPress, and similar), data flows between RealtrAI and the integrated service per the scope of the authorization you granted. You can revoke any integration at any time from the integrations panel; revocation does not retrieve data already transmitted.
No Endorsement
Listing of a third-party service does not constitute endorsement. We make no representations about the security, reliability, or availability of any third-party service. Disputes between you and a third-party service are between you and that service.
Outputs Are Not Professional Advice
Outputs generated by the Services (CMAs, valuation models, STR permit analyses, syndication memos, investor pitches) are informational and decision-support tools. They are not legal advice, financial advice, investment advice, or appraisal opinions. You and your clients should rely on appropriately licensed professionals for any matter that requires professional judgment.
Disclaimers & Limitation of Liability
Disclaimers
The Services are provided as is and as available. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components, that defects will be corrected, that any specific result will be achieved, or that data displayed will always be accurate or current. Property data, market data, MLS data, and regulatory data are sourced from third parties and are subject to those providers' freshness and accuracy.
Limitation of Liability
Our aggregate liability arising out of or related to these Terms or the Services is limited to the greater of (a) the amount you paid to us for the Services in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred US dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
No Liability for Decisions
You acknowledge that outputs from the Services are decision-support tools, not substitutes for professional judgment. We are not liable for transactional decisions, investment decisions, listing decisions, pricing decisions, or other professional decisions you or your clients make based on outputs from the Services.
Indemnification
You agree to indemnify, defend, and hold harmless RealtrAI, Trunnion AI, Viceroy NM, and our affiliates from and against claims, damages, losses, and reasonable attorneys' fees arising from (i) your use of the Services in violation of these Terms or applicable law, (ii) Your Content, including claims that Your Content infringes third-party rights, and (iii) your breach of representations or warranties in these Terms.
Termination
Termination by You
You may terminate your subscription at any time from account settings. Termination takes effect at the end of the current billing period. After termination, you retain access for ninety (90) days to export your archive, after which Your Content is permanently deleted from production systems per the data-retention policy described in the Privacy Policy.
Termination by Us
We may suspend or terminate your access for violation of these Terms (including the Acceptable Use section), for non-payment after the cure period, in response to lawful requests from authorities, or if continuing to provide the Services to you creates substantial risk to the platform or other accounts. Where reasonable, we provide notice and an opportunity to cure.
Effect of Termination
On termination, your right to access the Services ends. Provisions of these Terms that by their nature should survive termination (Content & IP, Disclaimers & Limitation of Liability, Indemnification, Governing Law) survive termination.
Governing Law & Disputes
Governing Law
These Terms are governed by the laws of the State of New Mexico, USA, without regard to conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Informal Resolution First
If you have a dispute with us, contact hello@realtrai.com with subject "Dispute" before initiating any formal proceeding. Most disputes can be resolved by direct discussion within thirty (30) days. We commit to engaging in good faith to resolve disputes informally.
Binding Arbitration
If informal resolution fails, any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures, with arbitration seated in Albuquerque, New Mexico. The arbitrator's award is final and may be entered in any court of competent jurisdiction.
Class Action Waiver
You and we agree that disputes will be resolved on an individual basis only. You waive the right to participate in any class action, class arbitration, or representative proceeding against us. If a court finds this class-action waiver unenforceable, the entire arbitration provision in this section is unenforceable and the dispute proceeds in court under the Governing Law provisions above.
Exception: Equitable Relief
Either party may seek injunctive or other equitable relief in a court of competent jurisdiction in Albuquerque, New Mexico for actual or threatened infringement of intellectual property or breach of confidentiality, without first proceeding to arbitration.
Opt-Out of Arbitration
You may opt out of the arbitration provision in this section by emailing hello@realtrai.com with subject "Arbitration Opt-Out" within thirty (30) days of first accepting these Terms. The opt-out applies only to the arbitration and class-waiver clauses; the rest of these Terms remain in effect.
Changes to These Terms
We may update these Terms from time to time. The "Effective" date at the top of these Terms is updated whenever we make changes.
Material Changes
For changes that materially affect your rights or obligations (price increases, scope reductions, new arbitration provisions), we provide notice at least thirty (30) days before the change takes effect. Notice may be by email, by an in-platform banner, or both. Continued use of the Services after the effective date constitutes acceptance of the updated Terms. If you do not accept, you may cancel the subscription before the change takes effect.
Minor Changes
For non-material changes (clarifications, formatting, typo corrections), we may update without prior notice. The version history is available on request.

Response Time
General inquiries are answered within five (5) business days. Formal disputes are acknowledged within five (5) business days and worked toward resolution within thirty (30) days. Urgent legal notices (subpoenas, court orders) should be flagged in the subject line; we treat those with same-day priority.
Entire Agreement; Severability; Waiver
These Terms together with the Privacy Policy constitute the entire agreement between you and us regarding the Services and supersede prior agreements on the subject. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver of that provision.
