1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of RealtrAI, a product of Viceroy NM ("Company," "we," "us," or "our"), accessible at realtrai.com and platform-realtrai.com. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.

2. Description of Service

RealtrAI provides AI-powered tools designed for real estate professionals, including but not limited to listing description generators, investor pitch builders, vacation rental calculators, follow-up email sequences, and additional productivity tools (collectively, the "Service"). The Service is powered by the Trunnion AI multi-agent orchestration framework developed by Viceroy NM.

3. Accounts

To access the Service, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration. You must be at least 18 years old to create an account.

4. Subscriptions & Billing

Plans

RealtrAI offers multiple subscription tiers: Starter, Pro, Team, and Brokerage. Each plan includes different feature sets and usage limits as described on our pricing page.

Free Trial

New users receive a 7-day free trial. No credit card is required to start a trial. At the end of the trial period, you must select a paid plan to continue using the Service.

Billing

Subscriptions are billed monthly or annually based on your selected billing cycle. Annual plans are billed upfront for the full year at a discounted rate. All prices are in U.S. dollars.

Cancellation

You may cancel your subscription at any time from your account billing settings. Upon cancellation, you retain access to the Service until the end of your current billing period. No refunds are provided for partial billing periods.

Changes to Pricing

We reserve the right to modify pricing with 30 days' advance notice. Price changes do not affect existing subscriptions until the next renewal period.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations, including Fair Housing laws. You agree not to:

• Use the Service to generate discriminatory, misleading, or fraudulent content
• Violate any local, state, federal, or international law or regulation
• Attempt to reverse-engineer, decompile, or extract the AI models or algorithms
• Share account credentials with unauthorized users
• Exceed the usage limits of your plan through automated or bulk access
• Use the Service to compete directly with RealtrAI or Viceroy NM products
• Upload malicious code, viruses, or harmful content

6. Intellectual Property

The RealtrAI platform, including its design, features, AI models, Trunnion AI framework, branding, and documentation, are the intellectual property of Viceroy NM and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without written permission.

7. Your Content

You retain ownership of all data you input into RealtrAI, including property details, listing information, and client data. You grant us a limited license to process this data solely for the purpose of providing the Service. We do not claim ownership of your inputs or use them for any purpose other than generating your requested content.

8. AI-Generated Content

Content generated by RealtrAI tools is provided for your professional use. You are granted a perpetual, non-exclusive license to use, modify, and distribute generated content for your real estate business purposes. Important considerations:

• Accuracy: AI-generated content should be reviewed for accuracy before use. We do not guarantee that generated content is free of errors.
• Fair Housing: While our tools are designed to produce Fair Housing-compliant content, you are ultimately responsible for ensuring compliance.
• No Model Training: Your data and generated content are never used to train AI models.
• Uniqueness: Generated content may share similarities with content generated for other users using similar inputs.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE MAKE NO REPRESENTATIONS REGARDING THE ACCURACY OR COMPLETENESS OF AI-GENERATED CONTENT, INCLUDING BUT NOT LIMITED TO FINANCIAL CALCULATIONS, MARKET DATA, AND PROPERTY DESCRIPTIONS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VICEROY NM AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. We may retain your data for 30 days following termination to allow for appeals or reactivation.

12. Governing Law

These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Bernalillo County, New Mexico.
